Section 6 - Digital Products, Instant Access, and Right of Withdrawal

All products sold by design syndrome are digital goods delivered electronically. No physical items are shipped. Once your order is complete, your files are made available for immediate download.

Because our products are delivered instantly, they are considered final once a download has begun. By completing a purchase and providing your consent at checkout, you request immediate access to your files and you acknowledge that the product is fully delivered, and therefore not refundable on a change-of-mind basis, once the download starts. This is explained in full in the "Instant access means final sale" section of our Refund Policy: https://designsyndrome.com/pages/return-policy. The finality of delivered downloads does not affect the refunds we offer for duplicate purchases, unresolved technical faults, or misrepresented products, which are also set out in that policy.

If you are a consumer in the European Union, you generally have a 14-day right of withdrawal on distance purchases. An exception applies to digital content not supplied on a tangible medium: under the EU Consumer Rights Directive, you lose this right once the download has begun, provided you gave your prior express consent to immediate access and acknowledged the loss of that right. You give this consent at checkout, and we confirm it to you by email. If you have not yet downloaded your files, you may still withdraw within the 14-day period by contacting us.

The right of withdrawal applies to consumers only. If you purchase as a business, freelancer, studio, or agency for professional use, the cooling-off period does not apply to your order.

Section 7 - Accuracy of Billing and Account Information

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order, including orders placed under the same customer account, the same credit card, or the same billing or shipping address. If we change or cancel an order, we may attempt to notify you using the email, billing address, or phone number provided at the time of the order. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.

You agree to provide current, complete, and accurate purchase and account information for all purchases. You agree to promptly update your account information, including your email address and payment details, so that we can complete your transactions and contact you as needed.

We may provide access to third-party tools that we neither monitor nor control. In no case shall design syndrome, our directors, officers, employees, affiliates, agents, contractors, suppliers, service providers, or licensors be liable for any injury, loss, or claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including lost profits, lost revenue, lost savings, loss of data, or replacement costs, whether based in contract, tort, strict liability, or otherwise, arising from your use of the Service or any products obtained through it. Because some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, in those jurisdictions our liability is limited to the maximum extent permitted by law.

Such a determination does not affect the validity and enforceability of any remaining provisions.

The obligations and liabilities of the parties incurred before the termination date survive the termination of this agreement for all purposes.

These Terms are effective unless and until terminated by either you or us. You may terminate them at any time by notifying us that you no longer wish to use our services, or by ceasing to use our site. If in our sole judgment you fail, or we suspect you have failed, to comply with any provision of these Terms, we may terminate this agreement at any time without notice, and you will remain liable for all amounts due up to and including the date of termination.

Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
